    §15 BAföG paragraph 3

Once the maximum period of time for grant qualification has expired, grants may still be given for an appropriate time according to the following factors:
    1. for serious reasons,
    2. (made void)
    3. due to participation in committees prescribed by law and statutory university and state institutions as well as in statutory bodies of the Student Union at these universities and “Studentenwerke”,
    4. as a result of failing the final exam for the first time,
    5. due to a disability, pregnancy or caring for and bringing up a child under ten years old
  • Avoiding a gap in funding after the fourth semester

According to §48 paragraph 1, clause 1 BAföG, from the fifth semester onwards, students only qualify for grants if they provide a certificate according to numbers 1, 2 or 3. Students can hand in this certificate within 4 months after the start of the semester, as long as it certifies the status of the previous semester. Upon presentation of this certificate they receive a back payment. This results in a gap in funding. Students have to bridge the gap until they receive the back payment.

As the law only stipulates that the certificate has to be issued after the start of the fourth semester, the semester completed at the time can also be the third semester. The important point is that the certificate isn’t issued before the start of the fourth semester. Upon presentation of the proof of suitability within the first 4 months of the fourth semester it would be sufficient if the student has achieved the usual results from three semesters.

As long as students present proof of achievement with the level of 3 semesters within the first 4 months of the fourth semester and complete the application for further funding from the fifth semester, there wouldn’t be a gap in funding.
